Responsibilities of the Injured Worker

  • Report the injury to their employer or supevisor as soon as possible.
  • Seek appropriate treatment for their injury.
  • If time is lost from work, provide their employer with a Prescribed Medical Certificate (available from the treating medical practitioner).
  • Participate actively and cooperate in their treatment and rehabilitation.
  • Do suitable tasks their doctor says they are fit to do.
  • Attend an examinaton by a medical expert nominated by the case manager, if requested (for an assessment only).
  • Notify their Claims Agent if returning to work or commencing paid employment.

Rights of the Injured Worker

  • Make a claim for compensation
  • Choose their own doctor or specialist and seek a second opinion.
  • To have a representative or support person (eg, union representative, solicitor, family member or interpreter) at meetings to discuss their claim.
  • Have any personal information kept confidential.
  • Have a copy of theuir rehabilitation plan/program and be consulted in its preparation.
  • Be provided with a copy of all medical reports relating to their claim by their Claims Agent.
  • Apply for a review of decisions made about their claim.

Your Rehabilitation  or Injury Management Consultant will provide you with a copy of the WorkCover handout "A guide to the workers compensation process and safe return to work".

If English is not your first language, this handout can, in some cases, be provided to you in your own language.  Your Rehabilitation Consultant will also arrange for an interpreter to assist you as required.

They will also answer any other questions you may have in relation to the rehabilitation and return to work process.  If they are unable to answer your questions, they will seek advice or put you on to someone who can help you.
